Authored by congressman Osmar Terra (MDB-RS), the bill has passed both houses of parliament and highlights measures to protect children and adolescents from violence, especially in the school environment and on the Internet.

Access the Law 14.811/2024 in full.

What the law defines

Classification of bullying and cyberbullying as crimes:

the new law typifies bullying as “Systematically intimidating, individually or in groups, by means of physical or psychological violence, one or more people, in an intentional and repetitive manner, without evident motivation, through acts of intimidation, humiliation or discrimination or verbal, moral, sexual, social, psychological, physical, material or virtual actions” and guarantees a fine as punishment, if the conduct does not constitute a more serious crime;

o cyberbullying is characterized in the legislation as follows: “if the conduct is carried out through a computer network, social network, applications, online games or any other digital medium or environment, or transmitted in real time”. Research by the Brazilian Institute of Geography and Statistics (IBGE) highlights the growth of these cases among students, highlighting the urgent need to tackle this phenomenon and the importance of combating bullying to ensure a safe and healthy environment for our children and teenagers.

Preventing and combating bullying and cyberbullying is everyone's responsibility, from parents and educators to government authorities. Below are some measures that can be adopted to prevent and tackle these forms of violence (Grosso, 2021):

education and awareness - it is essential to educate children and teenagers about the importance of respect, empathy and tolerance. Awareness campaigns in schools, lectures and training programs for teachers can help spread these values;

prevention policies - institutions, whether schools or companies, must implement policies to prevent and combat bullying and cyberbullying. These policies should include actions such as creating reporting channels, training employees and adequately punishing aggressors;

support for victims - it is essential to offer psychological and emotional support to victims of bullying and cyberbullying. Mental health professionals, such as psychologists and social workers, can help the victim deal with the damage caused and recover emotionally;

online monitoring - parents and guardians should monitor their children's online activity, setting limits and monitoring possible signs of cyberbullying. It is also important to teach children how to use the Internet safely and responsibly.

“To what extent can publishing images of a child compromise their safety, affect the construction of their identity and impact their development? Depending on the exposure, this can affect everything from their school performance to mental health issues such as anxiety, depression and self-esteem, as well as eating and sleeping disorders, among others,” explains Marina Fragata (2024), director of Applied Knowledge at the Maria Cecilia Souto Vidigal Foundation.

References

BRAZIL. Law n. 14.811, of January 12, 2024. Available at: https://www.planalto.gov.br/ccivil_03/_ato2023-2026/2024/lei/L14811.htm.
